40 CFR 266.505
Prohibition of sewering hazardous waste pharmaceuticals
All healthcare facilities are prohibited from sewering hazardous waste pharmaceuticals. See HW Drugs. This regulation applies to all impacted facilities regardless of generator status.
Healthcare facilities will need to identify which drugs are hazardous waste as these are restricted from being sewered.
This ban is effective immediately on a nationwide basis six (6) months after Subpart P is published in the federal register. States do not have to approve or adopt.
IMPORTANT - This sewer ban even applies to pharmaceuticals that are considered "Pharmaceutical Wastage" by the DEA (DEA letter to Practitioners - 10/17/2014). If a pharmaceutical is both DEA controlled and hazardous waste, even the waste left over after administration is prohibited from being drain disposed.
